These Terms of Service ("Terms") explain your rights and responsibilities when using Hush Chat. We aim to keep this document clear and readable while maintaining legally enforceable language.

Hush Chat is operated by Phantom Labs Pty Ltd T/AS Hush Chat (ABN 62671697000) ("Hush Chat", "we", "us"), with its principal place of business at Angel Place, Level 17, 123 Pitt Street, Sydney NSW 2000, Australia. By using Hush Chat, you enter into a binding agreement with Phantom Labs Pty Ltd T/AS Hush Chat under these Terms.

1. The Service

Hush Chat provides private, end-to-end encrypted communication through temporary rooms that exist only as long as participants remain connected. The service is provided on an "as-is" basis and may change, improve, or be discontinued at any time.

1.1 Registration & Anonymity

Hush Chat is designed to allow users to communicate securely and anonymously. Registration is only required for users who operate the service, such as creating rooms, managing encrypted spaces, and accessing subscription features.

Anyone joining a room via a shared link does not need an account. These participants remain anonymous, and we do not request or record any identity information about them.

1.2 Zero Logs & No Data Stored

Hush Chat is built around privacy and minimal data storage. We do not store message contents, room keys, decrypted data, connection metadata, or activity logs. All encryption and decryption take place solely in your browser.

We do not log IP addresses, device information, join/leave activity, or room interaction details. Once a session ends, the service retains no record of the conversation.

The only information we keep is what’s necessary for registered operators (for example, account credentials or subscription details).

2. Permitted Use & Community Rules

While Hush Chat supports free expression and does not read encrypted messages, users must not use the service to:

• Violate local, national, or international laws.
• Engage in harassment, exploitation, or content involving serious harm.
• Distribute malware, attempt to compromise the service, or interfere with system integrity.

We may suspend or terminate access for activity that poses legal, security, or operational risks.

3. Your Responsibilities

You agree to:

• Keep your devices and login credentials secure.
• Share room URLs only with trusted participants.
• Understand that we cannot recover room keys or message history.
• Back up any content you consider important.

4. Subscriptions, Cancellation & Refunds

Some Hush Chat features require a paid subscription. By subscribing, you authorize us to charge your chosen payment method at regular renewal intervals until you cancel.

• Auto-renewal: Paid plans renew automatically each billing cycle using your saved payment method until you cancel. You can schedule a cancellation at any time from the dashboard; your current plan remains active until the renewal date.
• You may cancel at any time. Your plan stays active until the end of the current billing cycle.
• No future renewals will be charged after cancellation.
• 7-day money-back guarantee: You may request a full refund within 7 days of any initial or renewal payment by contacting billing@hush.chat.
• After 7 days, payments are non-refundable unless required by law.
• Immediate upgrades that incur a charge are also covered by the 7-day refund window.
• Payment failures: If a renewal payment fails, we retry nightly (up to three attempts across seven days) and email you each time with a secure link to clear the outstanding balance. If the invoice remains unpaid after that window, the subscription is cancelled and your account reverts to the Free plan.

5. No Warranties & Limitation of Liability

Hush Chat is provided without warranties of any kind. To the maximum extent allowed by law, we are not liable for indirect, incidental, or consequential damages—including loss of data, service interruptions, or unauthorized access.

6. Changes to These Terms

We may update these Terms as the service evolves. Continued use of Hush Chat after updated Terms are published constitutes acceptance.

7. Governing Law

These Terms are governed by the laws of New South Wales and the Commonwealth of Australia. Mandatory consumer protection laws in your country of residence may also apply.
